This mandatory holiday will be effective as of October 1st 2024, and its implementation derives from a reform in the General Law of Institutions. This reform seeks to reduce the transition period between the presidential elections and the inauguration of the new head of the Federal Executive, as well as to streamline electoral procedures.
Mexican citizens will be able to enjoy this new mandatory rest day, a change that was approved by Congress two years ago. The reform went into effect on January 1st 2023, establishing that all workers, including those in learning institutions such as public colleges and schools, will have the right to rest to celebrate democracy and the peaceful transition of power in Mexico.
The Federal Labor Law clearly states that workers are not obliged to work on this day, considered as a mandatory day of rest. However, in exceptional situations where it is necessary to attend work due to the nature of the industry or profession, companies will be obliged to compensate employees in a special way.
According to the law, the company must pay the salary corresponding to that day, in addition to an amount equivalent to twice that salary as compensation for work on a mandatory rest day.
The addition of a new mandatory day off and rest to Mexico's work calendar is a significant measure that affects all workers in the country. This amendment, related to the transition of power in Mexico, seeks to improve electoral processes and give citizens the opportunity to celebrate democracy and the peaceful transition of power. The Federal Labor Law guarantees that workers are not obliged to work on this day and establishes compensation measures in exceptional cases.
Mexican presidents are limited to a single six-year term. Nobody who has held the post, even if that was on a caretaker basis, is allowed to run or serve again.
